CITY OF GRANDE PRAIRIE
BYLAW C-1155
A Bylaw to authorize the Mayor and City Clerk
to execute a renewal agreement granting ATCO Gas
and Pipelines Ltd. (the “Company”), the right to deliver
natural gas to customers within the City of Grande Prairie.
WHEREAS pursuant to the provisions of the Municipal Government Act, R.S.A. 2000, Chapter M-26, as amended (the “Act”), the City of Grande Prairie desires to grant and the Company desires to obtain, a franchise to provide natural gas services to customers within the City of Grande Prairie for a period of ten years subject to the right of renewal as set forth in the said agreement and in the said Act;
AND WHEREAS the Company has requested a franchise be granted to provide natural gas services to customers within the City of Grande Prairie;
AND WHEREAS it is deemed that such an agreement would be of benefit to the customers within the City of Grande Prairie.
NOW THEREFORE THE MUNICIPAL COUNCIL OF THE CITY OF GRANDE PRAIRIE, IN THE PROVINCE OF ALBERTA, DULY ASSEMBLED ENACTS AS FOLLOWS:
1. The Natural Gas Distribution System Franchise Agreement, a copy of which is attached hereto as Schedule “A”, be hereby ratified, confirmed and approved, and the Mayor and City Clerk are hereby authorized to enter into the Natural Gas Distribution System Franchise Agreement for and on behalf of the City of Grande Prairie.
2. The Natural Gas Distribution System Franchise Agreement attached hereto as Schedule “A” is hereby incorporated in and made part of this Bylaw.
3. Council consents to the exercise by the Company within the City of Grande Prairie of any of the powers given to the Company by the Water, Gas and Electric Companies Act, R.S.A. 2000, Chapter W-4, as amended.
4. This Bylaw shall come into force upon the Natural Gas Distribution System Agreement being approved by the Alberta Energy and Utilities Board and upon being given third reading and finally passed.
