BY-LAW C-741
A By-law to prohibit any other
person from providing
a public ambulance service within the corporate limits
of the City of Grande Prairie or any part thereof.

WHEREAS, pursuant to Section 166 of the
Municipal Government Act, Chapter 246 of the Revised Statutes of
Alberta, a Council may, by-law, provide an ambulance service in the
municipality, or any part thereof;
AND WHEREAS, pursuant to Section 166 of
the Municipal Government Act, Chapter 246 of the Revised Statutes
of Alberta, where the Council provides an ambulance service to all
or part of the municipality, the Council may, by-law, prohibit any
other person from providing a public ambulance service in the
municipality or any part thereof;
AND WHEREAS the City of Grande Prairie
entered into an Agreement dated the 10th day of May, A.D., 1976
(hereinafter referred to as the Ambulance Service Agreement) with
the Grande Prairie General and Auxiliary Hospital and Nursing Home
District No. 14 to provide reasonable ambulance service to the
residents of the City of Grande Prairie;
AND WHEREAS the said Ambulance Service
Agreement has been renewed yearly by the City of Grande
Prairie;
AND WHEREAS the City of Grande Prairie
deems the said Ambulance Service Agreement necessary and properly
conserves the public interest;
AND WHEREAS the Council of the City of
Grande Prairie deems it expedient and necessary to prohibit any
other person from providing a public ambulance service within the
corporate limits of the City of Grande Prairie or any part
thereof;
NOW THEREFORE, THE MUNICIPAL COUNCIL OF THE
CITY OF GRANDE PRAIRIE, IN THE PROVINCE OF ALBERTA, DULY ASSEMBLED,
ENACTS AS FOLLOWS:
1. This by-law shall be cited as "The Ambulance
By-law".
2. Definitions
a. "Act" means the Municipal Government Act being
Chapter 246 of the Revised Statutes of Alberta, 1970, as amended
and any Act substituted herefore;
b. "Ambulance" means a special motor vehicle
equipped for conveying the sick and wounded.
c. "Ambulance Service" means the providing of an
ambulance, or ambulances, to the residents of the City of Grande
Prairie, for the conveyance of the sick and wounded, whether or not
a fee is charged;
d. "City" means the City of Grande
Prairie.
e. "Hospital" means the Grande Prairie General
and Auxiliary Hospital and Nursing Home District No. 14.
f. "Owner" includes any person renting an
ambulance or having the exclusive use thereof under a lease or
license agreement.
g. "Operator" or "driver" means a person who
drives or is in physical control of an ambulance.
h. "Person" includes any firm, one or more
persons, a partnership and a corporation.
CITY TO PROVIDE AMBULANCE
SERVICE
3.1 The City of Grande Prairie shall provide an
ambulance service to the residents of the City by way of a written
Ambulance Service Agreement with the Hospital.
3.2 The Agreement with the Hospital dated the
10th day of May, A.D., 1976 and any renewals thereto, shall
constitute the written Ambulance Service Agreement for the purposes
of this by-law and shall remain in full force and effect, subject
to any amendments thereto, until specified otherwise by
Council.
3.3 The Ambulance Service Agreement referred to
in Section 3.2 above shall be marked Schedule "A" and is hereby
embodied in and made part of this by-law.
PROHIBITION
4.1 Subject to the provisions of Section 4.2
herein, no person, other than the City of Grande Prairie, shall
operate an ambulance service within the corporate limits of the
City of Grande Prairie.
4.2 Section 4.1 shall not apply to:
(a) The Volunteer ambulance service provided by
St. John Ambulance;
(b) A person operating an ambulance within the
corporate limits of the City of Grande Prairie where the service
being provided originated outside the corporate limits of the City
of Grande Prairie.
(c) A person operating an ambulance service
within the corporate limits of the City of Grande Prairie in
accordance with the terms of a written agreement approved by City
Council.
4.3 Notwithstanding Section 4.1, hereof, the
Provincial Ambulance Service of the Ministry of Health for the
Province of British Columbia may operate its ambulance service in
the City of Grande Prairie for the sole purpose of transporting
British Columbia residents from the hospital to the Province of
British Columbia, but not otherwise.

PENALTY
5. Any person who contravenes any provision of
this by-law is guilty of an offence and is liable on summary
conviction to a fine of Five Hundred Dollars ($500.00) and costs,
for every offence, and in default of payment thereof shall be
subject to imprisonment for a period not exceeding six (6)
months.
6. This by-law shall take effect on the day of
final passing thereof.
