I want to build my deck closer to the property line than what is required in the land use bylaw, can I do that?
You can request a variance. A Development Officer will review your proposal reviewing the layout of your property, type of deck, and requested setbacks proposed and consider either approve or refuse your request. For more information on variances click here or contact development services.

Q:
I have a ground level deck, do I need a Development Permit?
NO. Development permits are only required if your deck is 2ft (61cm) or higher.

Q:
How far into my rear and side yards can I place my deck (setbacks)?
If you are building a covered (with a roof) and/or enclosed (on the bottom) deck the minimum required setback from the rear property line is 25ft (7.62m). If your deck is open faced the minimum required setback from the rear property line is 15ft (4.6m).
If your property has no attached/detached garage and no rear lane access you can build an open faced deck within 4ft (1.22m) from the side property line.
